Condominium Corporation Legal Services
All members of the firm practise primarily
in the area of condominium law and provide a full range of services on
behalf of Condominium Corporations including, but not limited to, the
following:
- Full legal support in implementing the
new Ontario Condominium Act, 1998.
- Drafting by-laws and rules in response
to the new requirements and opportunities presented by the new Condominium
Act, 1998, and developing caselaw.
- Providing legal opinions on specific issues
having regard to the new director liability provisions in the Condominium
Act, 1998.
- Providing general advice with a view to
preventing problems before they arise in relation to the ongoing operation
of the Corporation.
- Providing advice with respect to the calling
and conducting of Board meetings and annual and special general meetings
of the owners, and attending and chairing meetings when requested.
- Reviewing contracts, leases and licences
in order to protect the interests of the Corporation.
- Providing advice and representation in
fulfilling statutory duties to ensure compliance with the Condominium
Act, 1998, and the Declaration, By-laws and Rules under the new
enforcement provisions that include mandatory mediation and arbitration.
- Providing Notices of Lien and registering
Certificates of Lien to secure priority of common expense arrears and,
if necessary, taking all legal steps required by law to enforce the
Lien, including Power of Sale proceedings, with all legal costs associated
with the collection of common expense arrears to be the sole responsibility
of the unit owner in arrears.
- A full range of condominium related litigation
and alternate dispute resolution representation before arbitrators,
mediators, Courts and Tribunals.
- Acting as Mediator of disputes under the
Condominium Act, 1998.
